The terms “we”, “us”, and “our” refer to Gifting U Ltd., registered in Malta under company number C32123633, with registered office at 15 Triq il-Villegaignon, Mdina, Malta, VAT number MT32123633, and email info@gifting-u.com.
GiftingUshop operates this online store (the “Store”) and website, including all related content, features, tools, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide these Services to you.
By accessing or using our Services, you agree to be bound by these Terms of Service (“Terms”) and our [Privacy Policy]. Please read these Terms carefully. If you do not agree to them, you must not use or access our Services.
1. ACCESS AND ACCOUNT
To use our Services, you must be at least the age of majority in your country of residence. You agree to provide accurate and complete information and to maintain the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
2. PRODUCTS AND DESCRIPTIONS
We strive to display our products as accurately as possible. However, product colors, materials, or details may vary slightly depending on your device settings. We do not guarantee that your expectations regarding appearance or quality will always be met.
We reserve the right to modify or discontinue any product at any time without prior notice.
3. ORDERS AND CONTRACT FORMATION
When you place an order, you make an offer to purchase. A binding contract is formed only when we confirm acceptance of your order and receive full payment.
If we are unable to fulfill your order (for example, due to stock unavailability or payment issues), we will notify you and issue a full refund where applicable.
Orders are for personal, non-commercial use only.
4. PRICES, TAXES, AND BILLING
Prices are shown in EUR and include applicable VAT unless stated otherwise. Shipping, handling, and customs duties (if any) are calculated at checkout.
We may modify prices or promotions at any time, but changes will not affect confirmed orders.
You agree to provide valid and up-to-date billing information. If payment is unsuccessful, we may suspend or cancel your order.
5. SHIPPING AND DELIVERY
We will ship products to the address you provide during checkout. Estimated delivery times are provided for reference only and are not guaranteed.
Once items are handed over to the carrier, risk passes to you. We are not liable for delivery delays caused by carriers, customs, or circumstances beyond our control.
6. RIGHT OF WITHDRAWAL (EU CONSUMERS)
If you are a consumer residing in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, in accordance with Articles 9 and 16 of Directive 2011/83/EU on Consumer Rights.

You must return the goods to 15 Triq il-Villegaignon, Mdina, Malta, in their original condition, unused and with all tags and packaging intact, within 14 days of informing us.
Return Shipping Costs
Unless otherwise agreed, you are responsible for the cost of returning goods.
Refunds
We will refund all payments received from you, including standard delivery costs, using the same payment method you used for the initial transaction, unless expressly agreed otherwise.
We will issue the refund within 14 days of receiving your returned items or proof of return.
Exceptions (Article 16, Directive 2011/83/EU)
The right of withdrawal does not apply to:

Perishable goods (e.g., food, flowers, or plants);

Sealed personal care or hygiene products once unsealed;

Digital goods once download or streaming has begun.
7. DAMAGES AND DEFECTS
Please inspect your order upon receipt and contact us immediately if your item is defective, damaged, or incorrect. We will evaluate the issue and provide a suitable resolution (repair, replacement, or refund).

All trademarks, logos, text, graphics, and content on this site are owned by Gifting U Ltd. or our licensors and protected under applicable copyright and trademark laws.
You may use our website for personal, non-commercial purposes only.

To the fullest extent permitted by law, GiftingUshop shall not be liable for indirect or consequential losses (including loss of profit, revenue, or data) arising from your use of the Services.
11. GOVERNING LAW AND JURISDICTION
These Terms and any disputes arising from them shall be governed by Maltese law.
If you are a consumer residing in the European Union, you will also benefit from any mandatory consumer protection provisions in your country of residence.
